By accessing or using this Site, you ("you" or "User") acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions (the "Terms"). If you do not agree with any part of these Terms, you must immediately cease using the Site. These Terms constitute a legally binding agreement between you and Balanced Trading LLC.

Arbitration and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any content or services provided through the Site shall be resolved exclusively through binding individual arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Santa Clara County, California, and shall be conducted by a single arbitrator.

You and Balanced Trading LLC each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against Balanced Trading LLC. If for any reason a claim proceeds in court rather than in arbitration, you and Balanced Trading LLC each waive any right to a jury trial.

SMS and Email Communications (TCPA Compliance)

By providing your mobile phone number and checking the SMS consent box on our Site, you provide your prior express written consent under the Telephone Consumer Protection Act (TCPA) to receive recurring automated marketing and informational text messages, including messages sent using an Automatic Telephone Dialing System (ATDS), from Balance Asset Management to the mobile number you provided. Message frequency varies. Your consent to receive SMS communications is not a condition of purchasing any goods or services from Balance Asset Management.

Standard message and data rates may apply. You are responsible for any messaging or data charges imposed by your mobile carrier. T-Mobile and all other wireless carriers are not liable for delayed or undelivered messages.

SMS Terms

• Message Frequency: Message frequency varies depending on the type of communication and your engagement. You may receive recurring messages.
• Costs: Msg & data rates may apply. Balance Asset Management does not charge for SMS messages, but carrier fees are your responsibility.
• Opt-Out: Reply STOP, QUIT, END, CANCEL, or UNSUBSCRIBE to any message to opt out. You will receive one final confirmation message.

• Supported Carriers: Our SMS program is supported by most major U.S. mobile carriers. T-Mobile and all other wireless carriers are not liable for delayed or undelivered messages.
